MoCRA Changed the Rules for Cosmetic Packaging Labels. Is Your Box Keeping Up?

The Modernization of Cosmetics Regulation Act became law on December 29, 2022, and it put new demands on cosmetic packaging that plenty of indie brands haven't caught. MoCRA layered new cosmetic labeling requirements over the FDA rules brands already followed, and small brands usually spot the gap only after the cartons come off the press. Fixing it then means a reprint.

Audit Cosmetic Packaging for MoCRA's Contact Line

Every U.S. cosmetic label now needs a reporting route. MoCRA added Section 609 to the FD&C Act, requiring a domestic address, phone number, or website where the responsible person receives adverse event reports. Private label cosmetic packaging carries the same duty, since the brand named on the label usually serves as the responsible person, even when a contract manufacturer fills every unit. FDA began enforcing it on December 29, 2024. Pull one finished unit per SKU and check that someone answers the listed contact, since the brand must send serious adverse event reports to FDA within 15 business days.

Plan Cosmetic Packaging Copy at the Dieline Stage

Compliance copy on FDA cosmetic labels needs a reserved spot. Designers who start with the front panel run out of room fast, because minimal fronts remain a strong beauty packaging trend and push every mandatory line onto side and back panels. Good packaging design for beauty products fixes those zones in place. Under 21 CFR 701.13, cosmetic packaging with a display panel of 5 square inches or less still needs net contents type at least 1/16 inch tall. Ask the printer for a marked dieline before artwork starts.

Fit Long INCI Lists on Small Containers

Lip products and minis rarely fit a full INCI list. 21 CFR 701.3 sets ingredient type at 1/16 inch minimum but allows 1/32 inch when the total labeling surface measures under 12 square inches. Past that, a firmly affixed tag, tape, or card works. Peel back and extended content formats turn custom product labels into small booklets with room for the full list, without forcing a bigger container. Have the converter test adhesion on the actual cosmetic packaging materials before the full run, since frosted glass, polypropylene, and PET each grip label adhesive differently.

Use the Outer Carton as Extra Label Space

A folding carton multiplies label space. A reverse tuck end lipstick carton adds four side panels plus two end flaps, and FDA expects the ingredient declaration on that outer container. Luxury cosmetic packaging can move that copy to the base of a rigid box and keep the lid clean for the logo, the foil, and nothing else. Brands dropping cartons for sustainable beauty packaging lose that space. Map every required line to a panel before cutting the carton, including the contact line, net contents, and full ingredient list that now have to live on the container itself.

Proof Every Panel Before Press Approval

Most reprints start with an unchecked file. Chemists adjust formulas late in development, often after marketing approves the artwork, and nobody updates the ingredient list on the carton to match the new spec sheet. Commercial printers such as Oliver, Inc. hold ISO 9001 certification for documented quality processes and G7 qualification for consistent color from one run to the next. The copy itself stays the brand's job. Before signing a hard proof, compare the artwork line by line against the latest formula sheet, the contact line on file, and the net contents on the fill spec.

Confirm Cosmetic Packaging Details With Regulatory Counsel

Treat all of this as general guidance. Congress directed FDA to propose fragrance allergen labeling rules by June 29, 2024, and the agency still hadn't issued them as of early 2026, which leaves MoCRA's labeling picture unfinished. Allergen names will need panel space too, once the rule lands. Regulatory counsel can confirm how each rule applies to a specific formula, claim, and sales channel, so book that review before every new SKU or reprint and leave spare room on the panel.

Every square inch on a small SKU is contested now. Brands that plan cosmetic packaging copy at the dieline and proof it against the current formula keep MoCRA's contact line, FDA's type rules, and future allergen disclosures on one print run.
